Dear colleagues,
It has come to the attention of the PIUG Board that the International Bureau of WIPO has unilaterally decided to cease applying IPC marks to many published documents without search report (KD code WO-A2). This policy has been implemented since early July 2005, and has resulted in the number of non-classified cases each week increasing dramatically from fewer than 10 to an average of 350 each week.
It appears that the majority of cases affected are those for which the USPTO is the designated International Search Authority, although it may be affecting other WO-A2 cases as well.
The PIUG is preparing a formal letter to WIPO, pointing out the damage which this policy is already doing to a number of databases, and will continue to do unless this decision is reversed. The full text of the final version of this letter will be reproduced in the next issue of the PIUG Newsletter, together with further explanation of the background to the case and any response from WIPO, if received in time.
In the meantime, all searchers should be aware that all sources (WIPO IPDL, CAS, WPI, INPADOC, PCTFULL etc) which draw upon PCT data are affected and that a proportion of the prior art will be irretrievable by IPC until this situation is remedied.
