Subject: Keyword Patent Searching
Roy,
My comments about keyword patent searching online are directed to
patentability searches - not infringement searches.
I've always been amused how inventors are directed to learn and use the
patent classification systems before they can conduct a good patent
search. This is self-serving and quite simply not true.
Practical considerations generally require that searching be conducted
on a limited budget and in a short timeframe. There will ALWAYS be
additional prior art that is never discovered by even the best
searchers, like yourself, no matter how much time and money is
allocated.
And, while the book is recommended for all searchers (even professional
searchers like you), it is suitable for beginners with Internet skills.
Regards,
--Gerald R. Black

Subject: RE: patent searching
Keyword searching is the best way to conduct patent research, if and
only if, one is hawking a book touting keyword searching for patents.
Patent classifications, US, international, or others, remain essential
tools to conduct patent research. The marvelous opportunity we
full-time searchers get everyday is to discover a limited set of highly
relevant references gleaned from a larger group retrieved via keywords,
then augment those based on the patent classifications found on those
keyword selected references. One always discovers additional prior
art via classified searching compared to keywords alone, but conversely,
we always discover additional references based on keywords instead of
classes. But no one who has to mount an infringement defense in court
would rely solely upon keyword searching. That would be obvious
malpractice.

Dear Jerry Black,
When I was in college, one of my professors insisted that we browse the
shelves in the library rather than just using the card catalog. I have
developed a love for owls from a book I found during one of those
browsing sessions that I never would have thought to look in the card
catalog for. I use keyword searching every day, but when I am having
trouble finding something, browsing is a very important tool.

Subject: patent searching
Beginning sometime late in the 19th century, patent searching was done
manually in the Patent Office. Using the patent classification system
or PCS (which is analogous to the Dewey Decimal System or DDC used in
libraries), patents involving similar technology are assigned similar
classifications and physically located together in the Patent Office.
Searching relied upon the patent classification system to locate the
best prior art.
Today, when you do a search on a computer terminal at a public library -
for TRAINS, you are directed to the site in the library where the books
about TRAINS are shelved. You don't use the DDC, except to know that
hard copies of the books about TRAINS are shelved together.
When searching for and printing patents online, the physical location of
the patent in the Patent Office is irrelevant. With the recent access
to global (including U.S. patents) online from the patent database, the
point has now been reached where advanced keyword patent searching
techniques can locate all of the best prior art in patentability
searches.
This is the premise of a new book - "Keyword Patent Searching Online."
KPSO makes a compelling case that keywords are now the best way to
search for patents online and obtain professional-quality search
results.
Four inventions are presented for the reader to search using basic
technologies. Each search is challenging and requires about four hours.
Step-by-step search solutions are provided that are easy to follow.
The search results show how each patent is located. The presentation
and layouts are completely original. KPSO is being used for seminars.
