According to Brazilian Industrial Property Law no. 9.279, of May 14,1996
An object of practical use, or part thereof, shall be patentable as utility
model if it is susceptible of industrial application, presents a new shape
or arrangement and involves inventive step, resulting in functional
improvement in its use or manufacture.
An utility model shall be considered as involving an inventive step if for a
person skilled in the art, it does not result commonly or usually from the
state-of-the-art
